Penalty Claims Helper

So you want to make a time claim. Below you will find a list of some of the most common time claims. Remember...Timekeeping likes to deny claims.

IT IS YOUR MONEY! Make the claim and follow up!

Here are a few simple steps to help you get the money that is owed to you for the work you perform.
  1. Always make your claims,
  2. Re-submit if denied
  3. Discuss with timekeeping the reason for the denial
  4. Turn a copy of the claim over to union rep for review
List of Claims:
Always include as much information as possible. Times, names, Train ID, Circ's, MP's, Board #'s, etc... Timekeeping will try to deny most claims and figure that you will not pursue it any further. Good for them...bad for us.

Follow up on your claims and get paid! $50-$100 may not seem like much for the effort it takes to get it, but multiply that by 30 claims a year. It makes a difference.

Call & Release

This claim is for  when a trainman is called and held on duty four hours or less, but not used during that period. He/she will be paid 1/2 day pay (65 miles) and will hold same spot on board as when called. If not released within four hours or member of crew moves engine from place where engine crew member takes charge of engine then full days pay (130 miles) will be awarded and trainman will go to bottom of board at time of release.

If trainman is called and released prior to leaving home and it is between the hours of 10pm and 6am then he/she is entitled to 1/2 day (65 miles) claim. Inform crew caller that you would like to be placed back on your board first out and not rested.
Rule 24 Oregon agreement

Call and released and showed up for work:

"I am claiming 65 miles for being called on duty and released without performing service on (date) at (time) for (assigned train). I was released by (name) at (time)."

Called and released prior to showing up to work:

"I am claiming 65 miles for being called on duty and released prior to leaving home between the hours of 10pm and 6am. I was called on (date) at (time) to be on duty on the (train id) at (time). I was then called at (time) and released from call."

You can print out a copy of your trans log if claim is denied and submit it with your claim. To do this you use this: zb (circ7) (board id) t t.

Making another start (Bring in train...go get another)

This claim is if you came in on your assigned train and called out to get another train (dogcatch) rather than tie up. This is not a claim if your are called for dogcatching.

"I am claiming 130 miles for making an additional start after arriving at my assigned trains final destination. Upon securing my train (train ID) at (circ7) at (time and date) I was instructed by MTO (name) to secure a van and go to (circ7 or MP) on the (subdivision) to board the (train ID) and bring it in to (circ7 or MP). I departed at (time and date) and arrived at (circ7 or MP) at (time and date). I tied up at (time and date)."

Conductor Only Violation (Missed Brakeman's Earnings)


This claim is used if your are told to violate your 3 train events. As a through freight conductor we limited per our agreements to making no more than 3 moves while enroute. (see crew consist agreement) Here is the claim if you are told to violate that.

"I am claiming missed brakeman's earnings (MBE) for exceeding 3 work events. I was called for the (train ID) on (date and time). While enroute between (origination circ 7) and (final circ 7) I was instructed by (who told you to perform more than 3 events) to perform more than 3 work events.

Event 1:   (circ 7) - Set out (# of cars) into track (track #) at (time of event).
Event 2:   (circ 7) - Picked up (# of cars) in track (track #) at (time of event).
Event 3...etc
Event 4...etc "



Difference in Earnings

This claim is used if you are used OA. For example, you are on a through freight pool as a conductor and you are pulled off of your turn and used as a brakeman on a different turn or pool. You are entitled to the difference in wages from what you made and what your turn made. Or if you are pulled off of your turn to cover another pool turn and your turn made more. Claim the difference!

"I am claiming the difference in earnings of conductor (name of person working your turn) on pool turn (your turn #)  working the (train ID) on (date of round trip) and my earnings while pulled off assignment while working the (train ID) on dates (date). I went on duty at (time) on the (train ID) and conductor (name of other conductor) was on duty at (time) on the (train ID). "Per article 53, sec E-1 of agreement"


Excessive Held Away


Per the Crew Consist Agreement, any held away more than 8 hours is to be paid above the extra board guarantee. "Trainmen held at the away-from-home terminal (HAHT) shall receive continuous held‑ away‑ from‑ home terminal time after being held 16 hours. No more than eight (8) hours of HAHT pay may be offset from an extra board guarantee during any one stay at the away‑from‑home terminal."


This is the claim for it.

"I am claiming my Held-Away-From-Home terminal wages.
No more than eight (8) hours of my HAHT pay may be offset from an extra board guarantee during any one stay at the away‑from‑home terminal. While working the (train ID and date) I was held away at (away from home circ 7) for (# of hours and minutes). I am claiming the (# of hours more than 8) hours and (minutes) of held away that were above (8) hours. This is to be paid above extra board guarantee per our Crew Consist Agreement. Thanks."
